These Terms and Conditions govern your use of rona.com.au and your purchase of products from Rona Audio (“Rona Audio”, “we”, “us”, “our”). By using our website or placing an order, you agree to these terms. Please also read our Privacy Policy, Refund Policy and End User Licence Agreement, which form part of these terms.
1. Using our website
You must be at least 18 years old, or have the consent of a parent or guardian, and be able to form a legally binding contract to buy from us. You agree to use the website lawfully and not to interfere with its operation or security, attempt to gain unauthorised access, or circumvent our licensing or activation systems.
2. Your account
Some purchases require an account. You are responsible for providing accurate information, keeping your login details secure, and for activity that occurs under your account. Tell us promptly if you believe your account has been compromised.
3. Our products
Our products are downloadable audio plugin software. They are licensed to you, not sold, and your use of them is governed by our End User Licence Agreement. We describe our products as accurately as we can, but system requirements, formats and features may change between versions.
4. Orders, prices and payment
Prices are shown in US dollars (USD) and include GST where applicable; for Australian customers the GST amount is also shown in Australian dollars on the tax invoice. Payment is processed by our payment provider (PayPal); we do not store your full card details. Your order is an offer to buy, which we may accept or decline. We may cancel an order and refund you if a product is unavailable or if there is an obvious pricing or description error.
5. Delivery of digital products
Products are delivered electronically. After payment is confirmed, your serial number and download links are made available to you and sent to your account email. It is your responsibility to provide a correct email address, to keep your serial numbers safe, and to check that your system meets the product’s requirements before purchasing.
6. Refunds and consumer rights
Our Refund Policy explains how refunds work. Nothing in these terms excludes, restricts or modifies the consumer guarantees you have under the Australian Consumer Law, which cannot be excluded.
7. Intellectual property
All content on this website and in our products — including software, audio, presets, text, images, logos and trade marks — is owned by Rona Audio or its licensors and is protected by law. You may view the website for your own use, but you must not copy, reproduce, scrape, republish or distribute our content or branding without our written permission, except as expressly allowed by your licence.
8. Acceptable use
You must not use our website or products for any unlawful purpose, to infringe others’ rights, to distribute malware, or to tamper with, reverse engineer or circumvent our security, licensing or activation systems except to the extent the law permits.
9. Third-party services
We rely on third parties (such as our payment provider) and may link to third-party websites. We are not responsible for third-party services or content, which are governed by their own terms.
10. Disclaimers and liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. Subject to those rights, and to the maximum extent permitted by law: the website and our products are provided “as is”; we are not liable for indirect, incidental or consequential loss, or for loss of data, profits or the inability to use a product; and our total liability to you for any claim is limited, at our option, to re-supplying the relevant product or refunding the amount you paid for it. You are responsible for keeping backups of your work and projects.
11. Suspension and termination
We may suspend or terminate your access to the website or a licence if you materially breach these terms or your licence, or to protect our systems or other customers. Licences may be revoked following a refund or chargeback.
12. Changes to these terms
We may update these terms from time to time. The current version is always available on this page, with the date it last changed shown above. Changes do not apply retrospectively to orders already placed.
13. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
